Terms of Service
These terms are an agreement between you and MenuPhotoLab LLC, a Georgia limited liability company ("MenuPhotoLab," "we," or "us"), and they cover your use of MenuPhotoLab, a tool for restaurants to turn their own dish photos into delivery-app-ready, website-ready, and social-ready images. By creating an account or using the service, you agree to them. Please read them before using the service.
1. The Service
MenuPhotoLab lets restaurants upload photos of dishes they actually serve and receive AI-enhanced versions sized for delivery platforms, your website, social media, and print, plus template-composited marketing graphics built from your own enhanced photos. The service enhances the staging around your food (lighting, background, framing); it is designed to work from your real dish, not to generate synthetic dishes that don't exist. See Section 5, Authenticity Commitments.
2. Accounts
You need an account, tied to one restaurant, to use MenuPhotoLab. You're responsible for keeping your login credentials secure and for all activity under your account. By creating an account you confirm you're authorized to act on behalf of the restaurant you register. You must be at least 18 years old and able to form a binding contract to create an account. This requirement was added on September 29, 2026 and takes effect on October 15, 2026.
3. Credits and Payment
Every new account gets 5 free photo credits, no card required. Additional credits come from a monthly subscription (Starter, Pro, or Multi-Location) or a one-time Credit Pack (Small, Medium, or Large). Credits never expire: unused subscription credits roll over from month to month, and credits already in your balance stay there if you cancel your subscription. Payments are processed by Stripe; MenuPhotoLab never stores your full card number. Subscriptions renew automatically each month until you cancel. If we change the price of your plan, we'll email you at least 30 days before the new price applies to your next renewal, so you have time to cancel. You can cancel at any time from your billing settings; cancellation stops the next renewal, and your plan stays active until the end of the period you already paid for. If a photo enhancement fails for a technical reason, the credit is returned to your balance automatically. For refunds beyond that, see our Money-Back Guarantee; when a payment is refunded, the credits it bought are removed from your balance.
4. Your Content and Rights
You keep ownership of every photo you upload, and you confirm you have the right to upload it, meaning it's a real photo of your own dish or restaurant. You grant MenuPhotoLab the limited license needed to process that photo (including sending it to the third-party AI providers described in our Privacy Policy) solely to generate the images and marketing assets you request. You own the enhanced results and may use them commercially (on your menu, delivery listings, website, ads, and printed materials) without further permission from us.
5. Authenticity Commitments
MenuPhotoLab is designed to enhance the real dish you photographed (the same food, the same portion, the same ingredients) by improving lighting, background, and framing, the way a photographer restyles a scene without touching the food itself. When you choose a presentation setting, MenuPhotoLab may also replace ordinary dinnerware, for example a chipped or mismatched plate with a clean one, but it is designed not to change a vessel that is part of the dish, such as a sizzling skillet or a stone bowl, and never to change the food. Authenticity Mode, when enabled, applies stricter limits intended to keep portion size and ingredients unchanged. AI results can still differ from your dish in small ways, which is why nothing is exported or published automatically: every result waits for your review and approval before it's used anywhere, and checking it is your responsibility (see Section 7). The dinnerware wording in this section was added on September 29, 2026 and takes effect on October 15, 2026.
6. Acceptable Use
Don't upload photos you don't have the rights to, use MenuPhotoLab to misrepresent food in a way that would mislead a customer, use the service for anything illegal, or attempt to abuse the free-credit system (for example, creating multiple accounts to repeatedly claim free credits). We may suspend or terminate accounts that violate these terms.
7. Your Responsibility for Published Images
You decide where and how your enhanced images are used, and you're responsible for that use. That includes making sure each image accurately represents the dish a customer will receive, and that your use follows the rules of the platforms you publish on (such as DoorDash, Uber Eats, and Grubhub) and any advertising or consumer protection law that applies to you.
8. Copyright Complaints
If you believe content on MenuPhotoLab infringes your copyright, send a notice to legal@menuphotolab.com that includes: your contact information; a description of the copyrighted work; a description of where the material appears on MenuPhotoLab; a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We remove material identified in a valid notice and terminate the accounts of repeat infringers.
9. Termination
You can stop using MenuPhotoLab at any time and delete your account yourself from Settings > Data & privacy, or ask us to do it. Unused credits are not refunded when you delete your account, except under our Money-Back Guarantee. We may suspend or terminate your account if you violate these terms, and we will tell you why unless the law or an ongoing investigation prevents it. When an account is closed, access ends, an active subscription is canceled, and your photos and personal data are deleted as described in our Privacy Policy, so download anything you want to keep first. Credits that were unused when an account is terminated for violating these terms are not refunded. Sections 4 and 7 through 14 continue to apply after your account is closed.
10. Disclaimers
MenuPhotoLab is provided "as is" and "as available." To the extent permitted by law, MenuPhotoLab LLC disclaims all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the service will be uninterrupted or error-free or that AI results will be accurate. Results depend on the quality of your source photo, and we don't guarantee a specific increase in orders or sales, even though industry data (including DoorDash's own merchant data) shows menu photos generally help. AI-enhanced images can contain mistakes, which is why every result waits for your review before it's used.
11. Limitation of Liability
To the extent permitted by law, MenuPhotoLab LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of (a) the amount you paid MenuPhotoLab in the 12 months before the event giving rise to the claim, or (b) $100. These limits do not apply to liability for our gross negligence, fraud, or willful misconduct, or to any liability that cannot be limited by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless MenuPhotoLab LLC and its owners from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from the content you upload, your use of the images you create with MenuPhotoLab (including any claim that an image misrepresented your food), or your violation of these terms.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Georgia, without regard to its conflict of law rules. Before filing a claim, please email legal@menuphotolab.com and give us 30 days to try to resolve it informally. Any dispute that isn't resolved that way will be decided exclusively in the state or federal courts located in the State of Georgia, and you and MenuPhotoLab consent to the jurisdiction of those courts.
14. General
These terms, together with our Privacy Policy and Money-Back Guarantee, are the entire agreement between you and MenuPhotoLab about the service. If any part of them is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver of it. You may not transfer these terms without our written consent; we may transfer them as part of a merger, acquisition, or sale of our business. If we provide these terms or our Privacy Policy in another language, the English version controls where they differ.
15. Changes to These Terms
We may update these terms from time to time, and each version carries a new "Last updated" date. For material changes, we'll email the address on your account at least 14 days before they take effect. Continuing to use MenuPhotoLab after changes take effect means you accept them. Changes don't apply to a dispute that arose before they took effect.
